Terms of Service for Spin Siam

Welcome to Spin Siam (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the website spinsiam.com (the “Site”) and any related services offered by Spin Siam, including the purchase of vinyl records. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must not use the Site.

These Terms form a binding contract between you (“you” or “Customer”) and Spin Siam, a business registered and operating in Thailand. We reserve the right to update these Terms at any time, with changes effective upon posting on the Site. Your continued use of the Site after changes constitutes acceptance.

Spin Siam specializes in the sale of new and used vinyl records, shipped exclusively within Thailand. All sales are subject to availability and these Terms.

1. Eligibility

You must be at least 20 years of age (the age of majority in Thailand) to use the Site or place an order. By using the Site, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

2. Account Registration

To place an order, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to update it as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.

We reserve the right to suspend or terminate accounts for violations of these Terms.

3. Products and Orders

Product Descriptions

We strive to provide accurate descriptions, images, and specifications for our vinyl records. However, variations in color, condition (especially for used records), or packaging may occur due to manufacturing or display limitations. Vinyl records are collectible items; we grade used records according to industry standards (e.g., VG+, NM), but you purchase at your own risk regarding subjective quality.

Ordering Process

  • All orders are subject to acceptance and availability.
  • Placing an order constitutes an offer to purchase. We may accept or reject it at our discretion (e.g., due to stock issues or payment problems).
  • Order confirmations will be sent via email. No order is binding until confirmed.

Pricing and Payment

  • Prices are in Thai Baht (THB) and include VAT where applicable. We reserve the right to correct pricing errors.
  • Shipping and handling fees are added at checkout and are non-refundable.
  • Payments are processed securely via bank transfer and/or PromptPay.
  • You authorize us to charge your payment method for the total amount upon order confirmation.

Payment Processing

We use Stripe, a third-party payment processor, to handle all payment transactions on our website. By using our payment services, you agree to be bound by the Stripe Services Agreement, which is incorporated into these Terms by reference. You also agree to provide accurate and complete payment information and authorize us and Stripe to process payments for the services or products you purchase.

Prohibited Activities: You may not use our payment services for any illegal, fraudulent, or unauthorized purposes, including activities that violate Stripe’s Restricted Businesses policies or applicable laws. Personal or family use of our payment services is prohibited.

Refunds and Cancellations: All payments are subject to our refund policy. Refunds, if applicable, will be processed through Stripe in accordance with our terms and may not be available for certain transactions or after specific timeframes.

Data Use: Personal data provided during payment processing (e.g., name, payment details, billing/shipping information) will be used solely to process your transaction, handle disputes or chargebacks, or comply with legal requirements, unless you provide additional consent. If you choose to save your payment information (e.g., via Stripe Link), this data may be stored by Stripe for future transactions, as described in their Privacy Policy.

Liability: We are not responsible for errors, delays, or issues caused by Stripe’s services, except as required by law. Any disputes regarding payments should be directed to us at contact@spinsiam.com and we will work with Stripe to resolve them.

4. Shipping and Delivery

  • All shipments are within Thailand via EMS.
  • Estimated delivery times are 2-5 business days, but delays may occur due to carrier issues or high demand. We are not liable for delays beyond our control.
  • You can track your order via the provided tracking number.
  • We do not ship internationally.

5. Returns, Refunds, and Cancellations

In compliance with Thailand’s Consumer Protection Act B.E. 2522 (1979), we provide the following rights:

Cancellations

  • Orders may be canceled before shipment for a full refund (excluding any processing fees). Contact us within 24 hours of order confirmation.

Returns

  • New Vinyl Records: 7-day return period from delivery for unused, unopened items in original condition. Shipping costs for returns are your responsibility.
  • Used Vinyl Records: Returns accepted within 7 days if the record does not match the described condition (e.g., significant scratches not disclosed).
  • To initiate a return, contact us with your order number and reason. Return the item to the following address within 7 days of approval:

No returns or refunds unless the product is defective or not as described (e.g. major scratches or defects not mentioned in the listing).

Sealed / Mint items: once opened, they are not eligible for return.

Buyers must provide a video of the full package opening (from unopened parcel to showing the product) to claim any defect or damage.

Minor cosmetic wear consistent with secondhand records (light marks, hairlines, sleeve wear, etc.) is not a valid reason for return.

By purchasing, the buyer accepts these terms.

You can contact us for a return within 7 days of receipt. Once 7 days have passed, we are unable to offer a refund.

To be eligible for a return, proof of defect must be provided, and your item must be returned to us unused and in the same condition that you received it.

Records are exempt from being returned for ‘change of mind’.

Refunds

  • Refunds processed within 7 days of receiving the returned item, via original payment method.
  • Refunds exclude shipping fees unless the return is due to our error (e.g., wrong item shipped).
  • Defective or damaged items (e.g., warped records due to shipping) qualify for replacement or refund at our discretion.

We do not offer exchanges for “change of mind” on used records due to their collectible nature.

6. Warranties and Disclaimers

  • We warrant that new vinyl records are free from defects in material and workmanship under normal use for 30 days from delivery.
  • Used records are sold “as is” with no warranties beyond accurate grading.
  • EXCEPT AS EXPRESSLY STATED, ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
  • We comply with the Consumer Protection Act, ensuring products are safe and descriptions are accurate. Report any unsafe products to the Office of the Consumer Protection Board (OCPB).

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING THE CONSUMER PROTECTION ACT:

  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT IN QUESTION.
  • WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR USE, EVEN IF ADVISED OF THE POSSIBILITY.
  • We are not responsible for damages from misuse, improper storage (e.g., exposure to heat/humidity affecting vinyl), or carrier errors.

8. Intellectual Property

All content on the Site, including images, descriptions, and trademarks (e.g., “Spin Siam”), is owned by us or our licensors and protected by Thai and international copyright laws. You may not reproduce, distribute, or use it without permission. Fair use for personal, non-commercial purposes is permitted.

9. User Conduct

You agree not to:

  • Use the Site for unlawful purposes.
  • Interfere with the Site’s operation (e.g., viruses, hacking).
  • Post false reviews or infringe third-party rights.

We may remove violating content and terminate access.

10. Privacy and Cookies

Your privacy is important. Please review our Privacy Policy for details on data collection and use. Our Cookie Policy explains cookie usage. By using the Site, you consent to these practices.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of Thailand, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the courts of Bangkok, Thailand.

Under the Consumer Protection Act, you may also file complaints with the OCPB (hotline: 1166) for issues like false advertising or unfair practices.

12. Force Majeure

We are not liable for delays or failures due to events beyond our control, such as natural disasters, strikes, or pandemics.

13. Miscellaneous

  • Severability: If any provision is invalid, the remainder remains enforceable.
  • No Waiver: Our failure to enforce a right does not waive it.
  • Entire Agreement: These Terms, plus our Privacy and Cookie Policies, constitute the full agreement.
